MGT255 Political, Legal And Ethical Environments Of Business

Course Description

This 9-week course focuses on the legal and regulatory environment of business. Topical areas include information on key functions of the law, dispute resolution, government agencies, contracts, tort law, property law, and international law. During this course, students will brief actual cases that illustrate the concepts being taught.

Topics and Objectives

Elements of Law

  • Explain the key functions of the American legal system.
  • Identify the sources and classifications of law.

The Judicial Process

  • Identify the basic trial procedures used in the American legal system.
  • Identify the relationship between the court system, litigation process, and jurisdiction.

Resolving Disputes and the Constitution

  • Compare and contrast the various forms of alternative dispute resolution (ADR).
  • Recognize the impact various amendments to the Bill of Rights have had on business.
  • Identify the business applications of the commerce clause, taxing power, and free speech.

Government Agencies

  • Describe the process by which administrative agencies make and enforce rules.
  • Describe the power of the legislative and judicial branches of government to review an agency's actions or decisions.

Elements of Traditional Business Law

  • Apply the implications of tort law on business practices.
  • Differentiate between real property and intellectual property.

Business Torts, Real and Intellectual Property

  • Differentiate between intentional torts against persons, intentional torts against property, and torts based on negligence.
  • Compare and contrast the legal protections available for real and intellectual properties.

Domestic and International Sales

  • Determine the Uniform Commercial Code's influence on the formation of sales contracts.
  • Compare and contrast the legal business environments of domestic and international trade.

Completing Your Project

  • Create a compilation of briefs illustrating the legal and regulatory environment of business.

Contracts

  • Relate specific contract remedies to various types of contract breaches.
  • Recognize the characteristics of various types of contracts.
